GENERAL CONTRACTING TERMS AND CONDITIONS 1. Introduction The purpose of this document is to regulate the GENERAL CONTRACTING TERMS AND CONDITIONS of the Pre-Reservation and On-line Booking services (hereinafter, and indistinctly, the Pre-Reservation and On-line Booking services, or the services) of Lifestyle Holidays Tenerife SL, with registered office at Urb. Palm Mar, Avda.el palm-mar 91, 38632 - Arona - Tenerife CIF B72947153 (hereinafter Lifestyle Holidays Tenerife SL or LHT, indistinctly), Tel. 922 732173. The terms "You" and "User" are used here to refer to all individuals and/or entities that for any reason access https://bookings.lifestyleholidaystenerife.com/ (hereinafter, the Website) or use the services. Use of the Pre-Reservation and On-line Reservation services by the User through the Website 2.1. Pre-Reservation Services The on-line Pre-Reservation services are merely informative, and their sole purpose is to offer the user the possibility of consulting the availability of a holiday home 2.2. The purpose of the on-line reservation services is to reserve the rooms that the User wishes to book at any of the hotels belonging to Lifestyle Holidays Tenerife SL. THE USE OF THESE ONLINE BOOKING SERVICES CONSTITUTES A CONTRACT BETWEEN THE PARTIES WITH FULL AND UNRESERVED ACCEPTANCE BY THE USER OF EACH AND EVERY ONE OF THE GENERAL TERMS AND CONDITIONS GOVERNING THE USE OF THIS, WITHOUT IT BEING NECESSARY OR REQUIRED BY THE PARTIES ITS WRITTEN TRANSCRIPTION. b. Contracting procedure: Once the reservation has been made through the website, THE USER WILL RECEIVE AN E-MAIL CONFIRMING THEIR RESERVATION. LIFESTYLE HOLIDAYS TENERIFE SL WILL ONLY BE BINDING FOR THOSE BOOKINGS CONFIRMED BY THE USER WHEN HE/SHE RECEIVES THE AFOREMENTIONED E-MAIL AND UNDER THE CONDITIONS INDICATED THEREIN. The user must verify the information contained in their booking confirmation and notify LIFESTYLE HOLIDAYS TENERIFE SL (at the address indicated in point 5 of these conditions), within twenty-four hours of receipt and in writing, of any errors noted. Otherwise, it will be understood that you are accepting the terms and conditions of the booking expressed in the confirmation e-mail. c. Guarantee: Once the confirmation e-mail has been received and no observations have been made by the User within the period indicated, the booking is firm and is guaranteed against the credit card provided by the User when making the booking until their arrival at the hotel. d. Termination of the contract or cancellation of the booking: The credit card is only a means of guarantee. The cancellation of reservations by the user will not incur early cancellation fees, provided that this is done before the time limit established in each country (local time of the hotel) on the day of arrival. After that time limit, LIFESTYLE HOLIDAYS TENERIFE SL will charge cancellation fees as compensation, which will amount to the amount of the first night (VAT and taxes included). If you wish to make any changes or cancel your reservation, you must do so in advance of the arrival date specified in the original reservation specified in the particular conditions of the rate or offer selected. If you do not do so, you will be subject to the charges specified. This clause is not valid for bookings made at special rates. In this case, the respective conditions will apply. The latest arrival times are those indicated in the booking made and which will be indicated both at the time of booking and in the booking confirmation email. THE CUSTOMER MAY CONTACT TO MAKE ANY CLAIM, EITHER THROUGH THE RECEPTION, OR THROUGH THE EMAIL ADDRESS: bookings@lifestyleholidaystenerife.com 5.2 LIFESTYLE HOLIDAYS TENERIFE SL IS NOT OBLIGED TO CONTROL AND DOES NOT CONTROL IN ADVANCE, THE ABSENCE OF VIRUSES OR ELEMENTS IN THE CONTENTS, WHICH MAY CAUSE ALTERATIONS IN THE SOFTWARE OR HARDWARE OF USERS OR PERSONS WHO VISIT THE WEBSITE, SO NOT LIABLE FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE ABOVE. 5.3 IF LIFESTYLE HOLIDAYS TENERIFE SL, DESPITE ACTING WITH DUE FORESIGHT AND DILIGENCE, IS UNABLE TO PROVIDE THE CONTRACTED ROOMS FOR REASONS NOT ATTRIBUTABLE TO THEM AND IT IS IMPOSSIBLE TO PROVIDE THE SERVICES UNDER THE AGREED CONDITIONS, IT WILL OFFER THE USER THE POSSIBILITY OF OPTING FOR A FULL REFUND OF THE AMOUNT PAID OR THE SUBSTITUTION OF THE CONTRACTED SERVICE FOR ANOTHER OF SIMILAR CHARACTERISTICS IN TERMS OF CATEGORY OR QUALITY. IF THE SUBSTITUTION OFFERED, THE SERVICE IS OF INFERIOR CATEGORY OR QUALITY, LIFESTYLE HOLIDAYS TENERIFE SL SHALL REIMBURSE THE DIFFERENCE TO THE USER. 6. Applicable Law and Competent Jurisdiction These General Terms and Conditions are governed by Spanish Law. LIFESTYLE HOLIDAYS TENERIFE SL and the User, for the resolution of any controversy that may arise with respect to their validity, execution, compliance or resolution, total or partial, submit themselves, expressly waiving their own jurisdiction or any other that may correspond to them, to the jurisdiction of the Courts and Tribunals of Tenerife. This contract constitutes the complete and integral expression of the agreement between LIFESTYLE HOLIDAYS TENERIFE SL and the user, and replaces all previous pacts, commitments, declarations or agreements, both written and oral, that may have previously existed between them.
